Boat & Trailer Seadoo Hoist Pier Space ATV ATV Trailer Golf Cart Utility Trailer Rentals (Step 2 – Waiver, Release and Voluntary Assumption of Risk) In consideration of 929242 Alberta Ltd., operating under the name and style "Willowbend Resort", permitting me, my dependants and visitors, to use the lands owned by Willowbend Resort, I, on behalf of myself, dependants and visitors, do hereby: Acknowledge and agree that there may be serious dangers and risks associated with the use of Willowbend Resort's property and facilities, including the common areas and the use of swiming and playground facilities and the access to and use of Lac La Nonne, including risk of serious personal injury or death; Acknowledge and agree I, my dependants and visitors are voluntarily undertaking such dangers and risks; and Release and forever discharge Willowbend Resort and its directors, officers, employees, contractors and agents from any and all claims, actions, suits, debts, costs, demands, losses and damages which are caused by any reason whatsoever, including without limitation the negligence of Willowbend Resort or its directors, officers, employees, contractors or agents and the negligence of any other users of Willowbend Resort's property and facilities. Rentals (Step 3 – Terms & Conditions) By completing and signing the first page(s) of the rental form (the "Rental Form") attached hereto, the Tenant hereby agrees with 929242 Alberta Ltd., operating under the name and style "Willowbend Resort" ("Willowbend"), as follows: 1. DEFINITIONS AND INTERPRETATION: The Tenant hereby acknowledges and agrees that: (a) all defined terms as set forth in the Rental Form shall apply throughout the Rental Form; (b) these terms and conditions, the "Rules and Regulations" document attached hereto and the "Waiver, Release and Voluntary Assumption of Risk" document attached hereto are incorporated into and forms a part of the Rental Form, and together with the first page(s) of the Rental Form collectively forms the terms and conditions of the agreement (the "Agreement") between the Tenant and Willowbend with respect to the Tenant's rental of the Recreational Lot; and (c) all fees and other amounts payable to Willowbend by the Tenant pursuant to this Agreement, including without limitation the fees to rent the Recreational Lot, any interest on overdue amounts and any administrative fees, may be recovered by Willowbend by any and all remedies available to it for the recovery of rent in arrears hereunder or pursuant to law. 2. LEASE: The Tenant shall lease the Recreational Lot from Willowbend for the Term, subject to the other provisions of these terms and conditions. 3. NON-ACCEPTANCE OF RENTAL: Within thirty (30) days after the receipt of the duly signed Rental Form from the Tenant, Willowbend may, as determined in its sole discretion, refuse to lease the Recreational Lot to the Tenant, in which case Willowbend shall refund all amounts paid by the Tenant (if any) on account of the fees and deposits for the Term payable as set forth on the first page of the Rental Form and the Tenant shall remove any of his property from Willowbend's lands, and upon such refund and removal this Agreement shall be terminated. 4. PAYMENT OF RENT AND OTHER CHARGES: The Tenant shall: (a) pay the rent and other charges set forth in the Rental Form on the dates as set forth therein; (b) be responsible to pay any and all other charges as set forth in this Agreement which are incurred by the Tenant or by the Tenant's family members and visitors as and when due, and if no due date is specified, within ten (10) days of the date that such charge was incurred by the Tenant or by the Tenant's family members or visitors. In the event that any cheques provided to Willowbend by the Tenant are returned to Willowbend as NSF (not sufficient funds), any pre-authorized automatic payment debit from the Tenant's bank account is refused by the respective financial institution, or any credit card charges authorized by the Tenant are refused or reversed by the credit card issuer, the Tenant shall pay to Willowbend an administrative fee of fifty ($50) dollars for each such occurrence, which shall be paid by the Tenant immediately upon notice of such occurrence from Willowbend. In such event, Willowbend shall be entitled to require the Tenant to pay any subsequent fees, deposits and charges due and owing to Willowbend by certified cheque or money order. 5. DEPOSITS: Any deposits paid by the Tenant will be applied at the end of the Term on account of any amounts due and owing by the Tenant in accordance with this Agreement in relation to the subject matter of such deposit or on account of the cost, time and effort of Willowbend to replace any property of Willowbend which is the subject matter of such deposit and which has not been returned to Willowbend upon the termination or expiry of this Agreement. 6. LATE PAYMENT: If any payment required pursuant to these terms and conditions are late or overdue, such payments shall be subject to interest at a rate of eighteen (18%) percent per annum calculated from the due date for such payment on the full amount then due and owing until payment in full is received by Willowbend. 7. RIGHT OF DISTRESS: In addition to, and without prejudice to, any other remedies available to Willowbend at law or equity for a breach of the terms and conditions of this Agreement, in the event that the Tenant fails to pay any fees, deposits or other charges as required pursuant to this Agreement, Willowbend shall be permitted to exercise a right of distress against any property of the Tenant located on Willowbend's lands. Such right of distress shall entitle Willowbend to retain a civil enforcement agency to seize and sell any such property in accordance with law. 8. OTHER GOODS AND SERVICES: The Tenant shall pay to Willowbend such other fees as may be determined by Willowbend from time to time for the provision of goods and services by Willowbend to, or at the request of, the Tenant. 9. USE OF LOT: The Tenant shall only use the Recreational Lot for the purposes of parking and using a recreational vehicle commonly referred to as an "R.V." and for associated camping activities, which the Tenant shall perform in a reasonable manner and in accordance with the other provisions of this Agreement. The Tenant shall maintain the Recreational Lot in a clean and tidy manner at all times. In the event that the Tenant fails to maintain the Recreational Lot in such manner, Willowbend shall be entitled clean the lot and the Tenant shall reimburse to Willowbend the cost of any such cleaning (which for the services of Willowbend's employees shall be charged at a rate of thirty-five ($35) dollars per hour) plus an administration fee equal to twenty (20%) percent of such cost immediately upon notice from Willowbend. 10. USE OF COMMON AREAS: The Tenant shall be permitted access to and use of the common areas of Willowbend's property adjacent to Lac La Nonne, Alberta as may be designated as such by Willowbend from time to time in its sole discretion, subject to any terms and conditions of use as may be determined by Willowbend from time to time in its sole discretion. If the Tenant is permitted by Willowbend, as determined by Willowbend in its sole discretion, to use any boats or all-terrain vehicles (quads) in such common areas, the Tenant shall exercise such use in a manner that is protective of the environment and respectful of other users of the common areas and of the owners and users of adjacent lands. At all times the Tenant shall, and shall cause all of its family members and visitors to, comply with and observe all rules and regulations relating to the use of boats and all-terrain vehicles (quads). In the event that any such rules and regulations are breached, Willowbend shall be entitled to prohibit the Tenant (and any of his family members and visitors) from using boats or all-terrain vehicles (quads) on Willowbend's lands, as determined in the sole discretion of Willowbend. 11. SERVICES: Except for the provision of power, a sewage tank and an RV water connection for the Recreational Lot (which Willowbend shall be entitled to turn off during the winter months and any other period when temperatures are generally or actually below freezing), the Tenant hereby acknowledges and agrees that Willowbend shall not be responsible for the provision of any other servicing to the Recreational Lot. The Tenant shall be responsible to reimburse to Willowbend for any power used with respect to the Recreational Lot within seven (7) days of written notice from Willowbend and shall be responsible for the emptying of the Recreational Lot's sewage tank by a date as determined by Willowbend. In the event of any failure of the Tenant to pay for any power utilities or to empty the Recreational Lot's sewage tank, Willowbend shall be entitled to retain any deposits paid by the Tenant to secure performance of such responsibilities by the Tenant, without prejudice to any other rights or remedies that Willowbend has pursuant to this Agreement, or pursuant to law or equity to seek damages against the Tenant for such failure. Notwithstanding the foregoing, Willowbend does not represent, warrant or guarantee that the provision of power for the Recreational Lot will be continuous or uninterrupted as power outages are common, and the Tenant shall and does hereby release Willowbend from any and all claims, actions and damages incurred by the Tenant arising from any power outages. 12. RULES AND REGULATIONS: The Tenant shall, and shall cause all of its family members and visitors to, comply with and observe the provisions of the attached "Rules and Regulations" document, which may be amended from time to time in the sole discretion of Willowbend upon reasonable notice to the Tenant. Any failure to observe and comply with the "Rules and Regulations" shall constitute a breach of this Agreement. 13. DAMAGE TO PERSONS AND PROPERTY: The Tenant shall be solely responsible for any damage caused by the Tenant or his family members or visitors in the course of using the Recreational Lot and any other property of Willowbend, including any common areas. The Tenant shall reimburse to Willowbend the cost of any repairs to Willowbend's property required due to the actions or omissions of the Tenant or his family members or visitors plus an administration fee equal to twenty (20%) percent of such cost immediately upon notice from Willowbend. 14. INSURANCE AND LICENCING: The Tenant shall obtain and maintain during the Term (and for any other period during which the Tenant has use of the Recreational Lot or otherwise has his property on the Willowbend lands) liability insurance with an insurer duly licensed in the Province of Alberta to cover any claims against the Tenant for property damage or injury caused due to the actions or omissions of the Tenant or his family members or visitors, with a minimum policy limit of one million ($1,000,000) dollars per claim. The Tenant shall further obtain and maintain any required licensing of all vehicles which the Tenant is permitted to use on the Willowbend lands pursuant to this Agreement, including without limitation any passenger vehicles, quads (all-terrain vehicles) and boats, and the Tenant shall insure the use of vehicles with an insurer duly licensed in the Province of Alberta with a minimum policy limit of one million ($1,000,000) dollars per claim. A copy of also such insurance policies required as set forth in this paragraph shall be provided to Willowbend on or prior to the commencement of the Term or indication and confirmation of such insurance policies on the internet format is considered as satisfying this obligation. In the event that the Tenant fails to provide a copy of such insurance policy, the Tenant shall pay to Willowbend an administrative fee of fifty ($50) dollars per week or part thereof during the period of time that such failure continues. 15. ASSUMPTION OF RISK AND RELEASE: The Tenant hereby acknowledges that there may be serious dangers and risks associated with the use of Willowbend's property and facilities, including the common areas and the use of swimming and playground facilities and the access to and use of Lac La Nonne, including risk of serious personal injury or death. The Tenant hereby acknowledges that he and his family members and visitors are voluntarily undertaking such dangers and risks. The Tenant, on behalf of himself and on behalf of his family members and visitors, hereby releases and forever discharges Willowbend and its directors, officers, employees, contractors and agents from any and all claims, actions, suits, debts, costs, demands, losses and damages which are caused by any reason whatsoever, including without limitation the negligence of Willowbend or its directors, officers, employees, contractors or agents and the negligence of any other users of Willowbend's property and facilities 16. INDEMNITY: The Tenant hereby indemnifies and holds harmless Willowbend and its directors, officers, employees, contractors and agents from any and all actions, losses, damages, claims or costs, including Willowbend and its directors, officers, employees, contractors and agents' costs on a solicitor and his own client basis, that may arise directly or indirectly against Willowbend or its directors, officers, employees, contractors or agents in favour of a third party with respect to or in any way connected or related to the Tenant's and his family members, visitors and invitees' use and occupation of the Recreational Lot and of any other property of Willowbend, including any common areas, or otherwise with respect to or in any way connected or related to the Tenant's breach of any of the terms and conditions of this Agreement. 17. TERMINATION: In the event that the Tenant breaches any terms or conditions of this Agreement, Willowbend may, at its option, terminate this Agreement upon seven (7) days prior written notice to the Tenant, without prejudice to any other remedy at law or equity that Willowbend may have for a breach of this Agreement, including without limitation Willowbend's right to seek damages against the Tenant for any such breach. In such event, Willowbend shall retain, and the Tenant absolutely forfeits, all payments made by the Tenant to the date of the termiation of this Agreement, including without limitation all unapplied or prepaid deposits and fees, and any fees and other charges payable by the Tenant for the remainder of the Term shall become due and payable immediately. For greater certainty, the Tenant shall not be entitled to terminate this Agreement before the expiry of the Term. In the event that the Tenant vacates or otherwise abandons the Recreational Lot prior to the expiry of the Term, the Tenant shall remain responsible for all amounts due and outstanding under this Agreement for the entire Term and the Tenant forfeits all unapplied or prepaid deposits and fees. 18. END OF TERM AND OVERHOLDING: Unless the Term has been renewed by agreement between the Tenant and Willowbend, at the expiry or early termination of the Term, the Tenant shall remove all of his property from the Recreational Lot and from any other property of Willowbend, including any common areas, and the Tenant shall leave the Recreational Lot in good and reasonable condition. In the event that Willowbend, as determined in its sole discretion, acting reasonably, is required to clean the Recreational Lot, the Tenant shall reimburse to Willowbend the cost of any such cleaning (which for the services of Willowbend's employees shall be charged at a rate of thirty-five ($35) dollars per hour) plus an administration fee equal to twenty (20%) percent of such cost immediately upon notice from Willowbend. In the event that the Tenant fails to remove any of his property upon the expiry or early termination of the Term, the Tenant shall pay to Willowbend a fee equal to thirty ($30) dollars for each day beyond the expiry or early termination of the Term as consideration for the storage of such property. In the event that such property is not claimed by the Tenant within five (5) days after the expiry or early termination of the Term, at any time thereafter such property may be deemed by Willowbend to have been abandoned by the Tenant, and Willowbend shall be entitled to claim legal and beneficial title over such abandoned property and be at liberty to remove and dispose of such property as it determines in its sole discretion, without any obligation to realize any value from such abandoned property. Any proceeds arising from such disposition shall be applied as follows: (a) first, against the costs of such removal and disposition; (b) second, towards any amounts due and owning by the Tenant to Willowbend; and (c) third, any amounts remaining shall be paid to the Tenant. In the event that such proceeds are insufficient to pay for the costs of such removal and disposition, then the Tenant shall reimburse to Willowbend such deficiency within seven (7) days of written notice to the Tenant. 19. RENEWAL OF TERM: In the event that the Tenant wishes to lease the Recreational Lot for the following season (May 1 to September 30 of the following year), the Tenant shall sign Willowbend's then current Rental Form prior to the expiry of the Term. In the event that the Tenant fails to do so, the Tenant acknowledges that Willowbend may thereafter lease the Recreational Lot to any other person. 20. WINTER PARKING AND STORAGE OF RECREATIONAL VEHICLES: Subject to the Tenant having complied with and observed all of its obligations under this Agreement, including without limitation the payment of all required fees and deposits to Willowbend as they become due and owing, the Tenant shall be permitted to leave and store the Tenant's recreational vehicles on the Recreational Lot from the date of the signing of the Rental Form until the commencement of the Term, so long as the Tenant continues to comply with and observe such obligations. 21. PROVISION OF OTHER TENANT INFORMATION: The Tenant shall provide to Willowbend such information as may be required by Willowbend from time to time, including without limitation information with respect to the make, model, serial number, licensing and insurance coverage of all boats and all-terrain vehicles that the Tenant is permitted to use on Willowbend's lands pursuant to this Agreement. In the event that the Tenant fails to provide any such information within ten (10) days of the request of Willowbend, the Tenant shall pay to Willowbend an administrative fee of fifty ($50) dollars per week or part thereof during the period of time that such failure continues. 22. COMPLIANCE WITH LAWS: In using the Recreational Lot and the common areas of the Willowbend lands, including without limitation all facilities provided by Willowbend, the Tenant shall, and shall cause his family members and visitors to, comply with all applicable federal, provincial, and municipal laws, statutes, rules, regulations, ordinances, codes and orders. 23. NOTICES: All notices, invoices, payments and formal communications (collectively referred to as "Notices") required or permitted to be given pursuant to these terms and conditions shall be in writing and shall be delivered personally or sent by prepaid registered mail as follows: (a) If to the Tenant, to the address of the Tenant as set forth on the first page of the Rental Form; or (b) If to Willowbend, to Site 7, Box 1, R.R. #1, Gunn, Alberta, T0E 1A0; or to such other address as the relevant party may notify from time to time. Notices sent by prepaid registered mail shall be deemed to be received by the addressee on the seventh (7th) day (excluding Saturdays, Sundays, statutory holidays and any period of postal disruption) following the mailing thereof. Notices personally served shall be deemed to be received when actually delivered, provided that such delivery shall be during normal business hours, otherwise such Notices shall be deemed received the following business day. 24. SUBLETTING AND ASSIGNMENT: The Tenant shall not sublet the Recreational Lot (including storing the property of any other person on the Recreational Lot, whether for consideration or otherwise), or assign any of its rights under these terms and conditions, without the prior written consent of Willowbend. 25. ENUREMENT: These terms and conditions shall enure to the benefit of and be binding upon the parties' respective successors and permitted assigns. 26. SURVIVAL: The obligation of the Tenant to pay to Willowbend any amounts due and owing pursuant to these terms and conditions, together with the provisions of paragraphs 15 and 16 above, shall survive the expiry or early termination of the Term and the agreement arising from these terms and conditions. 27. GENDERS AND PLURALS: As the context of these terms and conditions so requires, words that import the singular shall include the plural, and vice versa, and words that import a particular gender shall include all other genders. 28. GOVERNING LAW: These terms and conditions shall be governed and interpreted in accordance with the laws in force in the Province of Alberta. The parties hereby submit to the exclusive jurisdiction of the Courts of Alberta. The Tenant shall further obtain and maintain any required licencing of all vehicles which the Tenant is permitted to use on the Willowbend lands pursuant to this Agreement, including without limitation any passenger vehicles, quads (all terrain vehicles) and boats, and the Tenant shall insure the use of vehicles with an insurer duly licenced in the Province of Alberta with a minimum policy limit of one million ($1,000,000) dollars per claim.Consent* I acknowledge and swear that I have insurance coverage with a minimum policy liability limit of one million dollars per claim as per the aforementioned Terms and Conditions. Rentals (Step 5 – Rules and Regulations) 1. ELECTICAL POWER: Power outages from the power provider occur frequently at Lac La Nonne. As per the terms of the Rental, Willowbend Resort is not responsible for any losses, including loss of fridge content, due to any power outages. Please ensure that your unit is turned to propane or other source before you leave in case there is a power outage during your absence. 2. REFUSAL OF ENTRY: Willowbend Resort reserves the right to refuse entry to any persons. 3. QUIET TIME: Quiet time is from 11:00 p.m. to 8 a.m. the following day. Loud or offensive noises during quiet time (i.e., loud music, parties and barking dogs) are strictly prohibited. 4. SPEED LIMIT: You must at all times comply with and observe the speed limit on the Willowbend Resort lands of 10 km/hr. 5. GATE CARDS: Gate cards are for the sole use of the tenants. They are to be returned by termination of lease or deposit will be forfeited. 6. VISITORS: - All visitors must report to the Willowbend Resort store/office even if they are listed on the Tenant's five free visitors' list. Visitors not listed on the tenant's five free visitors list must pay the then current fee for admission to use Willowbend Resort lands and facilities (if applicable). Day visits will allow for one hour free of charge; for visits exceeding one hour, the visitor must pay the full day fee. - Tenant dependents, not traveling with the tenant, must report to the Willowbend Resort store/office. - Overnight visitor check out time is 12:00 NOON the following day. - All visitors are strictly prohibited from bring their own recreational vehicle, all-terrain vehicle and /or boat/watercraft onto Willowbend Resort Lands. 7. ADDITIONAL PARKING: Additional parking may be available, but in designated areas only. See the Willowbend Resort office for more details. 8. MINORS: All persons under the age of 14 years of age must be accompanied by an adult at all times while present on Willowbend Resort lands. 9. NOISES AND DISTURBANCES: You, your dependents and guests shall, at all times, act in a reasonable manner while present on the Willowbend Resort lands and shall not unreasonably interfere with the enjoyment of other persons on the lands. Holding loud parties or playing loud music is strictly prohibited. 10. ALCOHOL AND OTHER SUBSTANCES: Any alcohol present on the Willowbend Resort lands must be stored discretely, be out-of-sight in common areas and be consumed in a reasonable manner. Intoxication from alcohol or the use of prohibited substances is strictly prohibited. 11. GATE HOURS: The gate to the Willowbend Resort opens at 8:00 a.m. and closes at 11:00 p.m. daily. Store/office hours are as posted. 12. DIRT BIKES: The use and storage of dirt bikes on the Willowbend Resort lands is strictly prohibited. 13. DOGS/PETS: - All dogs and other pets must be leashed and cleaned up after on all Willowbend Resort lands. - No excessive barking or other noises are allowed as it disturbs the quiet of the campground. Use special dog equipment if necessary. - No dogs and other pets are allowed in the playgrounds, beach area, or in the water. - Dogs and other pets must be tied-up when on the tenant's lot or any other lots on the lands. 14. FIREWORKS, OTHER EXPLOSIVES AND HAZARDOUS SUBSTANCES: Use of fireworks or other explosives or any hazardous substances is strictly prohibited. 15. POWER EQUIPMENT: Use of lawnmowers, trimmers and power tools or equipment is restricted to the period between 10:00 a.m. and 8 p.m. daily. 16. USE OF WATER FOR NON-PERSONAL REASONS: Washing of Quads or R.V.s is only permitted between the hours of 8:00 p.m. and 10:00 p.m. daily, and watering of lawns is only permitted after 10:00 p.m. until midnight daily. 17. CONSTRUCTION: No Construction on the Willowbend Resort lands is allowed without the prior written approval of Willowbend Resort management. Proposed construction plans must be submitted to Willowbend Resort a minimum of ten (10) days prior to construction starting (obtain form at Office). 18. SHEDS: A maximum of one shed per lot is permitted, with the size of the shed not exceeding 10 ft. x 10 ft. x 10 ft. All sheds must be on skids. 19. WOOD: Tenants may maintain on their lots either, but not both, a wood storage shed or a woodpile. All woodsheds shall be constructed of metal roofs comprised of shingles (no tarps whatsoever as tarp restrictions are required to comply with Willowbend Resort's insurance policy). Woodpiles shall be neatly stacked. 20. SALE OF TENANT PROPERTY: Willowbend Resort's prior written permission is required before you may list any of your property on Willowbend Resort's lands for sale. 21. LOT MAINTENANCE: - All tenants shall ensure that their lots are maintained in a clean and tidy manner, and shall ensure that their lot's lawns are cut and watered regularly (especially if new sod has been planted), that lawn weeds are promptly removed and controlled and that all garbage is removed from the lots on a regular basis. - In the event that a tenant fails to maintain their lot in a clean and tidy manner, Willowbend shall be entitled to clean the lot and to charge the tenant a fee in accordance with the terms of the lease agreement with the tenant. - THE TENANTS SHALL NOT CAUSE OR PERMIT ANY NAILS TO BE INSERTED OR BE OTHERWISE EMBEDDED INTO ANY TREES. 22. GARBAGE/WASTE: Tenants must dispose of their own garbage in the dumpster provide by Willowbend Resort. Yard waste and lawn clippings must be disposed of in the containers provided by Willowbend Resort. Garbage or yard waste placed in wooded area or other than a container provided by Willowbend Resort is strictly prohibited. 23. TRAILERS: Roofs over trailers or over decks, and tarps of any kind, are strictly prohibited except for storage and protection purposes during the winter months and only when the Recreational Lot lease is current and in good standing. 24. SEWAGE PUMP OUT: Sewage pumpout shall be arranged with Willowbend Resort and current fees paid for each pumpout. The year-end sewage pumpout is arranged and conducted by Willowbend Resort. Should you intend using the lot during the winter months and the Recreational Lot lease is current and in good standing the sewage must be pumped out after every use. 25. INAPPROPRIATE AND ABUSIVE BEHAVIOR: Inappropriate conduct or abusive behaviour towards staff, management or other persons will not be tolerated. Those involved will be asked to seek another campground, and their lease will be terminated. Please help us maintain a positive and safe environment. 26. NOTICE OF NON-RENEWAL OF RECREATIONAL LOT LEASE: 30 days notice is required; September 1. 27. POOL AND BEACH USE: - THERE ARE NO LIFEGUARDS AT THE WILLOWBEND RESORT POOL OR AT THE WILLOWBEND RESORT BEACHES. SWIM AT YOUR OWN RISK. WILLOWBEND RESORT WILL NOT BE RESPONSIBLE FOR ANY BODILY INJURY OR DEATH TO ANY PERSONS. - Children under 14 years of age must be accompanied by an adult (18 years or older) when using the pool. - All pool users shall comply with and observe all rules pertinent to pool use as posted on the fence adjacent to the pool (i.e., no jumping, no diving, no smoking, no food, no drinks, no outside shoes on the pool deck). Willowbend Resort may, in its sole discretion, ban any person from using the pool in the event of a breach of such rules. - Parking in or around the pool or beach areas is strictly prohibited. 28. PLAYGROUND USE: - USE PLAYGROUNDS AND PLAYGROUND EQUIPMENT AT YOUR OWN RISK. WILLOWBEND RESORT WILL NOT BE RESPONSIBLE FOR ANY BODILY INJURY OR DEATH TO ANY PERSONS. - Parent must supervise their children while using and being around the playground areas and the playground equipment. - All playground users shall treat the playground equipment and the other users of the playground with respect. - Parking in or around the playground areas is strictly prohibited. 29. BOATS: - All boats, boat trailers and boat hoists must be registered; current fees paid to Willowbend Resort, and tagged. - Every boat/trailer/hoist without a tag will be removed in the fall of each year by Willowbend at the owner's expense. - For the duration of the season, boat(s) and /or trailer(s) must be stored only at area(s) designated by management. Boats may be stored for the winter months on the tenant's lots only with a current Recreational Lot lease in effect. If additional storage is needed, contact the Willowbend Resort management for designated areas. - USE THE PIER AT YOUR OWN RISK. WILLOWBEND RESORT WILL NOT BE RESPONSIBLE FOR ANY DAMAGE DONE TO BOATS, BOAT LIFTS, OR BOAT TRAILERS OR FOR ANY BODILY INJURY OR DEATH TO ANY PERSONS. 30. QUAD/ALL-TERRAIN VEHICLES: - Users of quads/all-terrain vehicles (if permitted by Willowbend Resort) must observe and comply with all applicable laws, bylaws, rules and regulations within the Lac Ste Anne County. - Quads/all-terrain vehicles must be registered at the Willowbend Resort office and proof of insurance must be provided. Quads/all-terrain vehicles and trailers must be tagged . There is a one-time fee as determined by Willowbend Resort per tag per quad. Each time a new quad/all-terrain vehicle is brought onto Willowbend Resort, it must be registered, the fee paid and proof of insurance provided. - Use of quads/all-terrain vehicles on the Willowbend Resort lands shall be restricted to the hours between 10:00 a.m. and 9:00 p.m. daily. Driving back and forth from and to trails outside of these hours is strictly prohibited. - Use of quads/all-terrain vehicles to access and use washroom facilities or to take garbage to the bins is strictly prohibited. Exceptions can be made for people with disabilities with the prior written consent of Willowbend Resort. - Driving quads/all-terrain vehicles in the park area is strictly prohibited: - Visitors are not allowed to bring in quads/all-terrain vehicles onto Willowbend Resort lands. - A $10.00 membership to the Lac La Nonne Enhancement and Protection Association (LEPA) must be purchased by all quad/all-terrain vehicle owners to assist LEPA with the work that it does in restoring the lake and taking care of the Bird Century at Lac La Nonne. - USE QUADS/ALL TERRAIN VEHICLES AND ALL TRAILS AT YOUR OWN RISK. WILLOWBEND RESORT WILL NOT BE RESPONSIBLE FOR ANY BODILY INJURY OR DEATH TO ANY PERSONS. 31. GOLF CARTS: - Golf Carts shall be operated only by persons with a valid Driver's License on roads only, within Willowbend Resort and not on the common grassed areas or lakeshore. - Golf Carts used after dark must be equipped with permanent head lights. - Owners must produce proof of Liability Insurance. - Pedestrians have right of way in Willowbend Resort. - Golf Carts operated by Management and/or Owners have unlimited access on common area within Willowbend Resort. - All passengers must be seated on appropriate seating. - Golf carts must always be operated in a safe and diligent manner.
